Report MyCare “False Positives”

OHCA/OCID has heard from members that some individuals have received “friendly letters” from the Department of Medicaid (ODM) suggesting they are eligible for MyCare Ohio even though they are not eligible. Examples of these individuals are people who live in ICFs-IID, people who have third-party coverage (such as a Medicare Advantage plan through State Teachers Retirement Service), people who don’t live in a MyCare region, or people who are not currently enrolled in both Medicare and Medicaid. These “false positives” are a particular concern because if the state’s records are not corrected, these individuals could end up being enrolled in a MyCare managed care plan even though they are not eligible for the program. We also have heard from many members that none or very few of their patients or residents have received the state’s notification. OHCA communicates regularly with ODM about MyCare Ohio, so we ask members to let us know about specific instances of beneficiaries who mistakenly have received or not received the MyCare friendly letter.

CMS Final HCBS Rule May Impact Ohio DD Waivers

CMS issued its much anticipated final rule defining Home and Community-Based (HCBS) settings under Medicaid waiver programs on Friday, January 10. Under the final rule it appears CMS has sought to maintain choice as a mainstay for people with disabilities. The final rule drops references to disability specific housing as constituting an institutional setting as written in original drafts. Services provided on or adjacent to an institution or that have the effect of isolating individuals from the community will be considered to be an institution, and subject to heightened scrutiny. The final rule requires that all home and community-based settings meet certain qualifications, including:

  • The setting is integrated in and supports full access to the greater community;
  • Is selected by the individual from among setting options;
  • Ensures individual rights of privacy, dignity and respect, and freedom from coercion and restraint;
  • Optimizes autonomy and independence in making life choices; and
  • Facilitates choice regarding services and who provides them.

The final rule also includes additional requirements for provider-owned or controlled home and community-based residential settings. These requirements include:

  • The individual has a lease or other legally enforceable agreement providing similar protections;
  • The individual has privacy in their unit including lockable doors, choice of roommates and freedom to furnish or decorate the unit;
  • The individual controls his/her own schedule including access to food at any time;
  • The individual can have visitors at any time; and
  • The setting is physically accessible.

There is still much that is not know, including how this will impact Ohio's DD waiver programs. DODD has scheduled a teleconference with stakeholders on January 24 to discuss how the Department will identify the issues and ensure that they are in compliance with the rule. OCID representatives will participate in this call and follow up with additional information to members. The final rule will take effect March 17, 2014 (60 days after the rule is published in the Federal Register on January 16, 2014). There is a transition period after the effective date. CMS is allowing states a one-year maximum timeframe to submit a transition plan for compliance with the final rule and CMS may approve transition plans up to five years to approve transition plans to ensure full compliance as supported by individual state's circumstance.

Draft Behavior Support Rule

The Ohio Department of Developmental Disabilities has been working with stakeholders, including OCID representatives, to develop a new behavior support rule that will apply broadly across the developmental disabilities service delivery system. The new rule will replace provisions regarding behavior support that currently exist in paragraph (J) of rule 5123:2-1-02 (County Board Administration) and rule 5123:2-3-25 (Discipline, Restraint, Behavior Modification, and Abuse of Residents). The draft new rule is available for review here. DODD is providing a “pre-clearance” opportunity to provide feedback that will inform final development of the new rule. OCID will submit comments on this rule; Please send any comments you would like added to Steve Mould at OCID by January 22. Check Updated LEIE Database
The US Department of Health and Human Services (HHS), Office of Inspector General (OIG) has just released its updated List of Excluded Individuals and Entities (LEIE) database file, which reflects all OIG exclusions and reinstatement actions up to, and including, those taken in December 2013. This new file is meant to replace the updated LEIE database file available for download last month. Individuals and entities that have been reinstated to the federal health care programs are not included in this file. The updated files are posted on OIG's website, and healthcare providers have an "affirmative duty" to check to ensure that excluded individuals are not working in their facilities or face significant fines. Instructional videos explaining how to use the online database and the downloadable files are also available on the OIG website. Given the penalties and recent government warnings, long term care providers should check the LEIE on a regular basis.

OHCA Participates in Senator Brown Press Conference on Improving Access to Medicare Coverage Act
U.S. Senator Sherrod Brown (D-OH) held a press conference at the MetroHealth Medical Center in Cleveland on Monday, January 13, regarding his legislation, the Improving Access to Medicare Coverage Act (S. 569), which would allow for the time patients spend in the hospital under “observation status” to count toward the requisite three-day hospital stay for coverage of skilled nursing care. OHCA President Michael Coury attended this important event on behalf of OHCA and AHCA/NCAL. The Senator was joined by a senior who had been injured but because she remained under “observation status” during her hospital stay, doctors told her that her therapy (or post-acute stay) would not be covered by Medicare. Also participating were Dr. James Campbell, the Director of Geriatric Health at Cleveland MetroHealth; and Richard Schwalberg, the Administrator of Cleveland’s Menorah Park, which provides skilled nursing care to seniors. AHCA/NCAL and several other provider and beneficiary groups have endorsed the Improving Access to Medicare Coverage Act. CMS “Discharge Planning” Booklet — Revised
The CMS “Discharge Planning” Booklet (ICN 908184) has been revised and is now available in downloadable format. This booklet is designed to provide education on Medicare discharge planning. It includes discharge planning information for Acute Care Hospitals, Inpatient Rehabilitation Facilities, and Long Term Care Hospitals; Home Health Agencies; Hospices; Inpatient Psychiatric Facilities; Long Term Care Facilities; and Swing Beds.

Nurses - Online Renewal Required For 2014
Starting with the 2014 LPN renewal, all nurses will be required to renew their licenses online. In the Spring of 2014 the Board will alert LPNs, through both email and mail, to renew their licenses. At that time, nurses will be able to access their User ID and Password for online renewal through the Board web site at www.nursing.ohio.gov.
