CMS recently published the first major changes to the Requirements of Participation for skilled nursing facilities (SNFs) in 25 years. As part of those revisions, the Federal resident rights were updated.
The law requires that SNFs promptly notify residents and their representatives when there is a change in resident rights under Federal or State law.
In addition, SNFs are required to obtain a written acknowledgement that they have informed residents in writing of their rights, and any amendments to those rights.Thus, it will be a best practice to promptly notify current residents and their representatives promptly after the Phase 1 compliance deadline on November 28 of the new Federal rights. In addition, it is recommended that SNFs inform their current employees of these new rights as well, in compliance with Ohio law.
OHCA, with the assistance of our legal counsel, Rolf Goffman Martin Lang LLP, has prepared a statement of Federal and State rights. It has been organized and prepared to present those rights in a language that residents and their representatives can understand. In addition, we have prepared a signature page where SNFs can have relevant parties acknowledge receipt of the rights.
