State
of the Union Features Jobs, Economy; Future of Health Care Reform Uncertain
President
Barack Obama highlighted the economy, education, energy, health care and
national security as areas on which he hopes to focus his – and Congress’ –
efforts in the coming year in his State of the
Union address on Wednesday. No details were provided, however, on health
care in general or long-term care specifically. As previously
reported, the future of health care reform legislation is still unknown.
AHCA reports that there are two options being discussed, but each has
significant political and/or procedural complications. One option being
discussed is to use budget reconciliation legislation having to do with spending
or cutting the budget, which can be considered under an expedited procedure.
The rules for considering a bill under budget reconciliation are very complex,
and therefore present many problems. Under another scenario, the House
could begin to pass a series of incremental reforms. Changes in insurance
rules such as barring the use of preexisting conditions, mandating the use of
community rating and guaranteed issue of policies, could be first on the list
of these mini bills, which would have to be passed by the Senate as well. No
matter which path is taken, most observers do not expect a rapid resolution.
