Action Needed to Oppose Nursing Home Arbitration Act
H.R. 6126, the Fairness in Nursing Home Arbitration Act of 2008, has passed the House Judiciary Committee and is awaiting floor action when Congress reconvenes in September. The Act would prohibit the use and enforcement of pre-dispute arbitration agreements in all long term care settings - including nursing homes and assisted living. AHCA/NCAL supports the use of arbitration because unlike traditional litigation, our members have experienced that arbitration is more efficient, less adversarial, and has a reduced time to settlement. If the legislation were to become law, even residents who voluntarily chose to submit to pre-dispute arbitration would have that right to choose denied, a right that is not denied in any other consumer transaction. Providers are encouraged to send a letter to their representative today and ask them to oppose this bill.
